GENERAL TERMS AND CONDITIONS OF SALE FOR TICKETING – Private individuals: 31 March 2026
1 - INTRODUCTORY PROVISIONS
Unless otherwise stipulated in writing and signed by the parties, these General Terms and Conditions of Sale (hereinafter the GTC) shall apply in full to any ticketing offer on the Castegens website (hereinafter ‘La Bataille’), such as access to Parc Aliénor and the Battle of Castillon show (hereinafter the Services) sold by the Castillon 1453 Association (hereinafter the Seller) to individuals or groups of individuals dealing directly with the association and comprising fewer than 20 people (hereinafter the Customers). These terms and conditions constitute the essential and governing provisions and take precedence over any document issued by the Customer or any leaflets and catalogues issued by the Seller, which are for information purposes only. Consequently, any order for Services placed with the Seller implies the Customer’s unreserved acceptance of these Terms and Conditions. The Seller may amend the T&Cs at any time. The fact that the Seller does not, at any given time, rely on any clause of the T&Cs shall not be construed as a waiver of the right to rely on all clauses at a later date. If any provision of the T&Cs is found to be void or invalid for any reason whatsoever, the remaining provisions shall remain unaffected and the Parties shall negotiate in good faith to amend the invalid provision. In these Terms and Conditions, ’Admission Tickets’ refer to tickets for entry to the shows and events offered at Parc Aliénor.
2 - ORDERING SERVICES (HEREINAFTER REFERRED TO AS THE ORDER)
2.1. Placing an Order Orders may be placed: At the Seller’s counter, located at 7 Allée de la République, BP 89, 33350 Castillon-la-Bataille. – by telephone on +33 (0) 5 57 40 14 53 from 9.30 am to 5.00 pm, Monday to Friday (standard call charges apply); On the Seller’s website, accessible at ‘https://www.batailledecastillon.com’ (hereinafter the ’Website’). In the Order, the Customer shall specify the date of the Services, the number of Access Vouchers requested and their delivery address (postal address and email address), as well as the names of the recipients of the Access Vouchers.
Where the buyer is entitled to a preferential rate (in particular through the use of a promotional code, a member rate or any other equivalent discount), they must expressly inform the seller of this at the start of the telephone call when making the booking, in order to benefit from it. Failing this, no claim will be accepted if the discount has not been applied, and no refund or credit note may be claimed at a later date.
Online ordering procedure on the Website: Orders are placed in French or English. To do so, the Customer selects the Services for a specific date and adds them to their basket. After clicking on ‘Book’, they enter their details in the fields provided (it is always possible to return to the previous step to amend the details entered), then they check the Order, including the description, price and payment terms for the Services, as well as the booking fee of €0.40 (including VAT) per show ticket (all categories combined), before confirming it. The Seller will acknowledge receipt by email, attaching the e-tickets once payment has been made (there is no obligation to print the tickets; they can be presented on a smartphone at the entrance). Bookings are managed and tickets issued using the WELOGIN ticketing software.
2.2. Effect of the Order: The Order is binding and final for the Customer, who may only cancel or amend it in accordance with the terms set out in the General Terms and Conditions of Sale. It is binding and final for the Seller following written confirmation (hereinafter ‘Confirmation’) of the Order by the Seller, sent electronically. Once the Customer has placed a final Order, they may contact us on 05 57 40 14 53.
3 - PRICES
The prices of the Services are those stated in the Seller’s leaflets and/or brochures and/or on the Website. They are quoted in euros and include VAT. They do not include booking fees for admission tickets, or any amendment fees (if applicable), nor do they include Customers’ personal expenses whilst at Aliénor Park. Where the price is based on the children’s age, the age taken into account is that on the first day of the Services. Proof of the children’s age may be requested at any time by the Seller’s staff. If such proof is not provided, the adult rate will apply. Children must be accompanied by an adult to enter the venue. Preferential rates may be granted to people with disabilities (PWDs) upon presentation of a valid proof of disability. If such proof is not presented, the standard rate will apply.
4 - PAYMENT TERMS
Orders placed at the counter: payment is made at the time of ordering by credit/debit card, by cheque made payable to the Seller, by bank transfer, by holiday vouchers or in cash. Remote orders (by telephone, fax, email or via the website): payment must be made by credit card via a secure procedure or via a secure payment link sent by email.
5 - ISSUE OF ADMISSION TICKETS
Once the Order has been paid for in full, the Access Passes and Exchange Vouchers will be, at the Customer's option :

In the event of loss or damage to Access Tickets, the Customer shall inform the Vendor as soon as possible and collect regenerated tickets from the Vendor's ticket office on the day of entry to the Battle site.
6 - TERMS AND CONDITIONS
Access passes are dated and valid only on the date stated on them. The Auberge Aliénor is accessible to guests holding an access pass on the same day as their park ticket, or from 7.00 pm onwards with a show-only ticket. Catering vouchers are only accepted at the Auberge Aliénor within the park. They are valid only for the duration of the current season. Pets are not permitted on site so as not to disturb the animals present at the show venue. Each paid show ticket is allocated a specific seat. Children entitled to free admission must sit on their accompanying adult’s lap throughout the performance and will also require a ticket (to be requested on site before entry). Seats in the stands must be occupied by 10.00 pm at the latest in July and August. After this time, the seat numbers originally purchased cannot be guaranteed.
Admission tickets for Aliénor Park are valid from 4.30 pm to 9.00 pm; Auberge dining tickets are valid from 7.00 pm to 9.00 pm; show tickets from 7.00 pm (stands open at 9.00 pm); the show starts at 10.00 pm in July and August (10.30 pm on the first weekend).
7 - CLAIMS
Any complaint relating to ticketing must be sent to the Seller by registered letter with acknowledgement of receipt, accompanied by all supporting documents, including the admission tickets, specifying the number of Customers. All such documentation must be submitted within 15 days of the provision of the Services. Any consumer may, free of charge, initiate a mediation procedure with: Médiateur du Tourisme et du Voyage – BP 80 303 – 85 823 Paris Cedex 17 – in accordance with the terms set out on the website ‘www.mtv.travel/’ within ninety (90) days of the matter being referred to the Seller and within a maximum period of one year from the date of the written complaint lodged with the Seller.
8 - MODIFICATIONS AND CANCELLATIONS BY THE CUSTOMER - CANCELLATION INSURANCE
Any request to amend tickets (including a change of date, seat, ticket type and/or seating category) will incur an administration fee of €5 (including VAT) per ticket, across all categories, subject to the availability of the categories originally purchased.
No refund will be given in the event of a downgrade. However, any request to upgrade will result in the payment of the corresponding price difference.
Access passes delivered to the Customer or collected in person are non-refundable. If the request for a change relates to a reduction in the number of people using the Services or to the cancellation of one or more of the Services ordered, the change shall be treated as a cancellation within the meaning of the following paragraph. Cancellation or non-attendance by the Customer on the agreed date: in the event of cancellation of all or part of the Order by the Customer, for whatever reason, the Customer shall not be entitled to any refund from the Seller. With regard to catering Services that have been booked, if the Customer does not arrive at the restaurant at least half an hour before the start of the show, the Customer may be redirected by the Seller’s staff to another catering venue; in which case, if the price at that catering outlet is lower than that of the original restaurant, no refund will be made.
A cancellation may be requested under the following circumstances: in the event of illness or serious temporary incapacity, permanent incapacity, a serious accident or death; property damage or burglary requiring the customer’s presence; serious damage to the insured person’s vehicle occurring within four hours prior to departure; a summons to sit a resit examination as part of higher education; a requirement to be present notified by the customer’s employer; the birth of the insured person’s child; a general transport strike; theft of tickets and associated bookings. Administration fees relating to online sales, amounting to €0.40 (including VAT) per event ticket, paid at the time of ordering, are non-refundable, including in the event of cancellation of the order by the seller and/or the buyer, as well as in the other situations mentioned above. These fees are deemed to have been definitively forfeited as soon as the online order is processed.
9 - MODIFICATION AND CANCELLATION BY THE SELLER
The Seller may at any time remove or amend the Services offered in its brochures and on its website. Where, prior to the date of performance of the Services, the performance of any of the essential Services (namely: access to the Castegens site and catering services) of the Order is rendered impossible as a result of an external event beyond the Seller’s control, the Seller shall notify the Customer as soon as possible and propose an amendment to the Order, by post, email or telephone. The Customer may then: – either request the cancellation of the Order, without penalty or charges and with a full refund, by registered letter with acknowledgement of receipt sent to the Seller within twenty days of the date originally agreed for these services, – or accept the amendment proposed by the Seller. The Customer shall notify the Seller of their choice in writing as soon as possible. Where, during the Customer’s visit to the Castegens site, any of the Services covered by the Order cannot be performed by the Seller for an unjustified reason other than force majeure, the Seller shall, as far as possible, offer the Customer an alternative Service in place of the Service not provided. In the event of cancellation, by the Seller or the organiser of the event, of a performance of the Battle (whether or not due to a prefectural order, in the event of rain, the show will go ahead) subject to the express condition that the cancellation takes place before half of the Battle show has elapsed, tickets for the show will be refunded in full upon request. This request must be made in writing, accompanied by supporting documentation, within 30 days of the cancellation, failing which it will be deemed inadmissible.
10 - INTELLECTUAL PROPERTY
The Seller retains full and complete ownership of its intellectual property rights. The Customer shall refrain from copying or imitating them, directly or indirectly. Any reproduction of the brand and identification signs belonging to the Seller is subject to prior written approval by the Seller.
11 - PERSONAL DATA
Subject to the Customer’s consent at the time of placing the Order, this personal data is processed electronically in order to provide Customers with information about the Seller’s services and offers. This personal data may also be passed on to the Seller’s partners where this is necessary for the performance of the Services, in particular to the Seller’s partner responsible for processing online bookings. In accordance with legal provisions, Customers have the right to access, rectify and object to the processing of their personal data. This right may be exercised: By registering free of charge on a ‘do not call’ register; By writing to the Seller at the following address: Association Castillon 1453, 5 Allée de la République BP 89, 33 350 Castillon-la-Bataille. In accordance with Article L.223-2 of the Consumer Code, the Customer is informed of their right to register on the cold-calling opt-out list, accessible via the website http://www.bloctel.gouv.fr
12 - LIABILITY
The Vendor shall under no circumstances be held liable in the event of non-execution or poor execution of the Order attributable to the Customer or to the unforeseeable and insurmountable act of a third party.
13 - FORCE MAJEURE
The Vendor's obligations shall be automatically suspended, without the Vendor being liable for any non-performance whatsoever, in the event of force majeure and, in general, in the event of an event beyond its control preventing the normal performance of the Order. The Vendor shall inform the Customer of the occurrence of such an event by e-mail or telephone, specifying the Services concerned. If the force majeure event or its consequences continue for more than 20 days from the date of the e-mail or telephone call, either Party may cancel that part of the Order which the Vendor is unable to fulfil, by registered letter with acknowledgement of receipt, without such cancellation giving rise to any compensation, penalty or indemnity whatsoever.
14 • AMENDMENTS TO THE TERMS AND CONDITIONS
The Seller reserves the right to amend the General Terms and Conditions at any time without prior notice. Such amendments shall be reflected by updating and dating the said terms and conditions. It is understood that these amendments will only apply to Orders placed thereafter. It is therefore essential that the Customer consults the general and specific terms and conditions at the time of making their booking, in particular to ensure they are aware of the provisions in force.

16 - DISPUTES
The General Terms and Conditions and the fulfilment of Orders are governed by French law. Any dispute arising in connection with the conclusion, performance, interpretation or termination of the Order shall be subject to the jurisdiction of the French courts, subject to: (i) in the case of business customers, where the Parties agree that jurisdiction shall lie with the Commercial Court of Libourne; (ii) where applicable, the mandatory rules of the Customer’s country of residence, in the event that the Customer is a non-professional resident in a foreign country to which the Seller directs its commercial activities.
17 • Withdrawal
In accordance with Article L221-28 of the Consumer Code, tickets for leisure activities taking place on a specific date are not subject to the right of withdrawal.
Either sent immediately by email (e-ticket) in the case of a purchase made online or by telephone; ;
Or sent by post within a maximum of 7 working days, subject to payment of the applicable administration fee of €5 (including VAT), to the address provided by the Customer and confirmed by the Seller when a booking reference number was issued, in the case of a purchase made by telephone.
